COVID REFUND GUARANTEE
1. In case an MT Performance organised activity does not go ahead due to lockdown or you need to cancel due to COVID-19 related reasons, we will organise a full refund within 14 days from the cancellation. For cancellations not affected by COVID-19, the usual Terms & Conditions will apply.
CANCELLATIONS
2. Swim Clinics: If you are unable to attend a Swim Clinic and must cancel you should do so in writing by sending an email to swim@mt-performance.co.uk and the following cancellation charges will apply: Full fees will be retained if the applicant cancels a Swim Clinic within 7 days of the Swim Clinic start date. Non-attendance without notice will automatically be treated as a booking cancellation. A 10% administration fee will be retained if applicant cancels a Swim Clinic prior to 14 days before the Swim Clinic start date. The rest of the Swim Clinic fee will be refunded via bank transfer - all transfer costs need to be covered by the customer.
3. Private Training Sessions: A separate cancellation and refund policy applies for bookings of Private Training Sessions: If you are unable to attend a Private Training Session and must cancel you should do so in writing by sending an email to swim@mt-performance.co.uk and the following cancellation charges will apply: Full fees will be retained if the applicant cancels a Private Training Session within 24 hours of the Private Training Session start date and time. Non-attendance without notice will automatically be treated as a booking cancellation. A 10% administration fee will be retained if applicant cancels a Private Training Session prior to 24 hours before the Private Training Session start date and time. The rest of the Private Training Session fee will be refunded via bank transfer - all transfer costs need to be covered by the customer. MT Performance may, at its discretion, offer an alternative date and time for your Private Training Session only if the applicant cancels prior to 24 hours before the Private Training Session start date and time.
4. MT Performance reserves the right to cancel any activity at any time if the venue notifies us that facilities are not fit for use on the activity dates or that their availability has changed for any other reason or in case the coach allocated to these activities will not be fit to coach or cannot get to the venue on time.
5. MT Performance reserves the right to cancel any activity up to 2 days before the start date if numbers enrolled have not reached the minimum requirement. In the event of a cancellation all applicants will be notified as soon as possible and a full refund of the activity fee will be given within 14 working days after the cancellation. We cannot be held responsible for any other losses incurred as a result of any cancellation.
OUR LIABILITY TO YOU
6. MT Performance shall ensure that our activities you enrol to are in accordance to our promotional materials as well as these Terms & Conditions and shall be performed by us with reasonable skill and care. ENROLMENT
7. To successfully enrol an applicant please complete the application form and transfer the full activity fee (details will be sent via email). No booking is secured until the full payment is received and a booking confirmation emailed to the applicant. All bookings are subject to availability and MT Performance reserves the right to decline any booking at its discretion.
PAYMENT METHODS
8. We will only accept payment via bank transfer. Please be aware that all bank charges related to the payment must be paid by the applicant. If making payment from abroad please make sure that we receive the whole amount in £GBP.
PHOTOGRAPHS/VIDEOS
9. Photographs and videos may be taken and used for marketing purposes – objections in writing to swim@mt-performance.co.ukwill be respected.
10. Copyright of all photography and video remains the property of MT Performance. Videos recorded for training purposes will be shared with featured applicants using the website – www.wetransfer.com.
JURISDICTION CLAUSE
11. Your booking grounds the contract between you and MT Performance in English law and the exclusive jurisdiction of the English Courts. The contract is formed when we email you a booking confirmation. Your contract cannot be amended unless confirmed in writing by an authorised representative of MT Performance and yourself.
TIMETABLE
12. We always aim to deliver our activities according to advertised timetables, however MT Performance reserves the right to make further changes to any activity timetable at any point if required. There will be no refund offered if requested based on any scheduling changes.
CHANGE OF VENUE
13. In case the venue for an activity notifies us that facilities are not fit for use on activity dates or that their availability has changed for any other reason, MT Performance reserves the right to try to find an alternative venue and run the activity in a new location. We will notify all enrolled applicants about this change as soon as possible. If the activity runs in the newly confirmed location / venue no refunds will be offered. We cannot be held responsible for any losses incurred as a result of such a change.
CANCELLATION DUE TO VENUE CANCELLATION
14. MT Performance reserves the right to cancel any activity at any point in case the activity venue notifies us that the facilities are not fit for use on activity dates or cancels our venue hire booking. In the event of cancellation all applicants will be notified as soon as possible and a full refund of the activity fee will be given within 14 working days after the cancellation. We cannot be held responsible for any other losses incurred as a result of such cancellations.
FORCE MAJEURE (’Event outside our control’): DELAY OR FAILURE TO PERFORM
15. We shall not be liable to you if we are prevented or delayed in the performing of any of our obligations to you if this is due to any cause beyond our reasonable control including (without limitation); an act of God, illness/virus outbreak, explosion, flood, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work; any form of government intervention; a third party act or omission; failure by you to notify us of any changes of supplied information.
SAFETY
16. Regulations made for the safety and comfort of activity attendees, staff and others must be observed at all times.
BEHAVIOUR
17. In order to guarantee the safety and enjoyment of all attendees MT Performance reserves the right to discipline and in extreme cases to send anyone home at the parent or guardian’s expenses, without the refund of fees.
PERSONAL LOSS / INJURY
18. MT Performance staff will take all reasonable care of every attendee. However MT Performance accepts no responsibility for any illness, personal injury, or for any loss or damage to individuals' personal property whilst they are attending our activity, except in the case of proven negligence on part of MT Performance and for this purpose MT Performance carries mandatory third party cover for the activities carried out. The parent or guardian enrolling their child to our activities agrees that the applicant is voluntarily participating with the knowledge of the inherent and other risks (both known and unknown) in our activities. The applicant and parent/guardian accept full responsibility for any injury, damage, death or other loss resulting from these risks and/or resulting from the applicant’s own negligence or other misconduct.
PERSONAL PROPERTY
19. MT Performance will not be liable for any item of personal property brought by an attendee to our activities. Attendees are advised not to bring with them items such as mobile phones, personal music or media devices, jewellery, cash or other valuables. An attendee’s personal property is the attendee’s own responsibility unless loss or damage is proven to be due to MT Performance’ negligence. If anything is missing, please notify staff immediately as there may still be time to find it before the end of the activity. Items of property left behind by an attendee may be disposed of if not claimed and collected within 20 days of the end of our activity. We will endeavour to return items to their rightful owners, however delivery costs might be charged.
INSURANCE
20. Attendees are encouraged to take out medical/accident/travel insurance, to cover injury or sickness during or prior to an activity, for their own financial and personal security. Non UK citizens and non UK nationals need to provide MT Performance with a copy of travel insurance covering swimming events in the UK before their enrolment onto any activity can be confirmed. Please be advised to ensure that your insurance policy covers: medical emergencies, cancellation and personal effects.
SUITABILITY TO ATTEND OUR COURSES
21. MT Performance reserves the right to determine the suitability of an applicant to participate, and the right not to accept a booking or exclude an applicant from our activities. MT Performance must be advised at the time of booking about any medical, social and/or behavioural issues that may affect the activity environment for the individual, other participants and anyone working at our courses. Disabilities or relevant medical conditions should be discussed with us at the time of booking in order that we can advise you as to the suitability of your chosen course. MT Performance also reserves the right to refuse a booking or exclude an individual from courses if this information comes to light at a later stage of the booking process or during the activity. In the event of any individual being excluded or withdrawn from any part of an activity, no refund or reduction will be made. In addition, any costs incurred by MT Performance in connection with an individual being asked to leave our courses, will be the full responsibility of the person’s parent or guardian who will be expected to bear the cost in full.
YOUR RESPONSIBILITIES
22. It is your responsibility to ensure MT Performance is fully notified of any dietary needs, behavioural, medical or social problems that the applicant may have, particularly when those needs might affect the applicant or other participants during our activities. This is to ensure that MT Performance is able to provide a suitable level of care and supervision, to enable all participants to participate fully in our activities and to prevent individuals attending our activities who may require a higher level of (medical) care or supervision than MT Performance can reasonably provide.
ADMINISTERING MEDICINES TO PARTICIPANTS
23. Whenever possible, medication should be given at home and every effort should be made to avoid activity hours. In case there is a need of medicine administering during the activity hours please indicate so in your application form or once enrolled as soon as possible and request an Authorisation for Dispensing Medication Form. This form has to be filled in and submitted with your application or latest at the start of the course.
FIRST AID / URGENT TREATMENT CONSENT
24. I, being the parent/carer/legal guardian herby give my permission for the administration of basic first aid treatment by staff or lifeguards supplied by the venue. In the event of an emergency I also authorise the staff or lifeguards supplied by the venue to take appropriate action to obtain necessary medical help for my child, including sending them to hospital. I also give permission for the staff to give the immediately necessary authority on my behalf for any medical or surgical treatment recommended by competent medical authorities, where it would be contrary to the child’s interest, in the doctor’s medical opinion, for any delay to be incurred by seeking my personal consent.
COMPLAINTS
25. In the event a participant has a problem or a complaint, it is important that they bring it to the attention of staff as soon as it arises. Any member of staff can be approached and will be willing to give assistance. If the problem is not resolved satisfactory the participant should contact MT Performance who have overall responsibility for our activities. Official complaints should be directed to MT Performance in writing by emailing: swim@mt-performance.co.uk.
COLLECTION AUTHORISATION
26. For your child’s personal safety if a chaperone other than the parent is collecting your child please inform MT Performance while stating the name and relationship of the chaperone (please inform the chaperones that they may be asked to provide Photo ID for security purposes).
TRAVEL CONSENT
27. I give my consent for my child to use any mode of transport during the activity organised by MT Performance (for example: for a trip to a doctor’s surgery or A&E). I give my consent, that under circumstances considered appropriate by MT Performance, for my child to walk between any facilities or on a public road where necessary, accompanied by MT Performance Staff. I understand that every care will be taken to safeguard my child, but that the organisers cannot be held responsible for loss, damage or injury caused or suffered by my child arising during the journey.
YOUR INFORMATION
28. All personal information will be handled sensitively and confidentially. We shall only store and use the information you supply to us for the purposes of carrying out our contract with you. We will only inform you of other services and activities which we may make available in the future if you have indicated that we have your permission to do so on your most recent application.
